Hi Guys,

just a note to make you aware of a bad experience I have had recently with a seller on ebay.

I won an auction for a Beach Shelter last week and paid my money soon after. I chased up the delivery and heard nothing back. then I noticed a refund on my bank account for the item. I checked my mail to be told that -

Hi, Sincere apologies our courrier is unable to ship this out of main land UK. Sorry for the disappointment caused.

The items was listed with delivery to the UK, Co. Antrim is part of the UK unless I am mistaken...

I was very peeved with this and decided to leave negative feedback for this seller - oh what a horents nest I have opened...

Lets just say that there have been quite a few emails going back and forth and some of the verbals I have received from this guy are offensive to say the least - e.g.

Which part of"ALL couriors charge more for off mainland" do you not Get??

Anyway, your 100% record has now gone! (in reference to my ebay rating)

I just hope that next time you try to buy something large from the mainland you dont resort to negative feedback for an innocent seller.And you accept that you are wrong (in reference to me stating that it does not cost extra to ship to NI from UK mainland).

I would ask anyone thinking of buying anything to consider the posting options and if the details are not clear, seek clarification.

As for this guy and his rotten attitude, I will leave it up to you if you want to buy from him, I for one will not be.

Gavin if the UK won't have you then we will down here. No need for thanks, what else could we do? At least then experiences like you had won't be a surprise :wink: :lol: :wink: .

Hi Jude,

I understand where you are coming from, but personally I think the seller done the right thing, even if his attitude sucked. I mean you were refunded in full, and an apology was issued. Having traded on e-bay myself many times and with the above seller without any hassles I think negitive feedback should not have been left in this case. Neutral would have been better, in my opinion. Others may agree with your choice though.

surely unless he stated 'UK mainland post only' then it is his responsibility to post it to you for the price you paid him for it, if hes out more he should have done his research better before hand?
i know it does cost more to post items ie rods etc to here from the mainland but surely his problem, not yours in this case?

Thanks for your comments Mac, but I know my rights on this and if the items states UK delivery (with no exceptions stated) then I am covered as I live in the UK.

If I brought this case to the Office of Fair Trading, the guy would be forced to ship the goods to me at the prices stated. I have mentioned this on my last mail and he has gone very quiet.

Hi Jude.
I bought from this supplier once.
I had no problems with him - The postage was for U.K. And he posted at the U.K. rates as stated on his listing.
But it was only for hooks, Not a heavy or bulky item.
I can't understand why it should make any difference. I bought a rod from a seller in England and it cost £19.00 postage.
I also sold a rod to a buyer to the mainland and it also cost me £19.00 to post it.
Seems Strange

Maybe he was in a bad mood :idea:

I'll tell you about the mails when I next see you mate - he claimed that it would cost £55 to send the parcel, I challenged this and got a price of £8.50 from TNT (although the price I got was for a parcel half the weight).

He then claimed that he couldn't send it for less than £40.

The more I think about this, the more it is annoying me - I think I will get onto Fair Trading and see what they say - after all, everything is in writing....

It is just the bloody priciple of the thing that is annoying me....

I wouldn't think that you would have a chance in the Fair trading.
Put in a complaint to ebay. Thats all you can do!! They may give them a warning, and If there has been other warnings, They may suspend or cancel their account.
But i doubt it, unless they have at least 6 neg feedbacks and complaints in a row.
In other words - Learn from experience. And forget it :cry:

i had problem from this guy before i orderd a fishing box and when i got it it was broken i told him .
he say you sign for it not my problem and the end i got my money back it took him two months to give me left him neg feedback .
since then i never get anything from him again he is sad wee man i give what you said to him .
i hate that when you order something it dear to post to ni but its the same to the mainland sellers moves the goal posts .

to most people in england Uk is england scotland wales most of them are not even aware that there is a wee bit of ireland in the UK.
to be honest if you got your money back in good time you probably dont have much to complain about - and judging by some of the other posts you are as well staying clear of him any way.

postage to NI is expensive for big and or heavy stuff and when the post office brings in its new rates it will be even worse.

Those were my thoughts as well Ray. So many sellers on Ebay think of England and forget that there is some oversea transport required for Northern Ireland. For hooks and the likes there will be very little difference if any at all so they will bite the bullet there. Maybe the seller should have been considerate enough to list extra to NI, but they can't cover all bases. Jude, I also think you have a point, The guy said the UK and he should ship to the UK at the price listed...... but if he is going to loose money on the sale then you can't really blame him. He should have been more polite in his dealings for sure.

Hey Gavin, you wont get any joy with Ebay, their service is pretty crap, as I had a similar experience whereas a guy withdrew an item from auction hours before the end because he wanted more for the item but did not put a reserve.I complained to Ebay & they just shrugged their shoulders and said there was nothing they could do.That was the last time I used Ebay, as they need to clean up their Act & thier Rules as guys will just start a new username if they get negative comments.

some thing else that occured to me...ebay being an auction may be different but if a shop advertises a price there is no obligation in law to sell at that price or indeed any price. for it to be actionable you would have to prove that it was the vendors intention to deceive as the advertising of a price is not a contract rather it is an invitation to treat. for this reason if you go to a shop that avertises some thing for £10 and you go into the shop and the guy says "tell you what, its early closing today im in a good mood you can have it for £7.50" he is not breaking the law as he would be if the advertised price was a contract.

as i say ebay is technically at least an auction so this may all be moot!!!

And if your living in certain parts of England, like i used to, to them only England is the UK! :lol:

I've sent things to and from england and majority of times prices were same both ways.
I think some people take the pi*s out of delivery charges to NI, all you have to do is look at some online stores, one will send and item via Royal mail for say £4.95 the other company will ask £15 for the same item cause they use a a different courier...

But as for Ebay complaints system, i've got to agree its a complete utter waste of time.

It is just the principle of the thing that has annoyed me most and I am not one to lie down, especially in the case of poor service. I work in Sales and would not treat any of my clients like this so I expect the same in return.

The situation is different down South, the price displayed is the price you pay. There have been instances of retailers being fined for charging higher than displayed prices on items.

on the situation in eire i cant speak, but in british law you must prove intent to mislead. there was a case recently of Argos advertising Tvs at some ridiculous price, i dont rember what it was exactly £2.12 or something they did not have sell any at this price as it was held to have been an error (honest mistake), many places place such value on their good name that they will bite the bullet and let you have it at the advertised price - and then withdraw the item from sale so no one else gets it.

all i can say about eire and it is only a guess is that IF the advertising of a price forms a binding contract (and i dont see how it can) then every time some one gives a bit of discount they are breaking the law.

some aspects of british law work like this one that comes to mind is alcohol, if you go into a bar and ask for a single vodka (or whatever) and the bar man gives you a double WITHOUT ASKING YOUR CONSENT he is commiting an offence.

My beef is with this fact - the item was listed as delivery to UK only at £8.95, this to me acts as a contracted price for delivery within the UK.

The seller has decided not to uphold this offer even though it is detailled in writing.
