Estuary question

#1 Post by rockyb23 »

Quick question:

I know of one local river where downstream of a certain point, the fishing is free (as in, not fishery- or club-controlled) because the river is tidal from that point down.

The question is - is this the same for all rivers? Once it becomes tidal, does that mean it can't be restricted? Or does it vary from river to river?

How would you go about finding out what point is regarded as the cut-off point, aside from the obvious?

Rocky- not sure if you are in RoI or NI. I think there could be difference between the rules. Any club member will tell you the river is reserved rite until the actual end of it- where it meets the sea. However this may not always be the case. I know some clubs in NI that dont have 100% of the river due to government and farmers not giving exclusive permission. My advice would be to contact the relevent govt body that looks after the rivers in NI i know it is DCAL ( http://www.dcalni.gov.uk/ ). Ask their advise as they should be impartial and give an honest opinion.

Generally, with a nod of recognition towards the massively complicated issue of riparian ownership, the sea extends to the mean high water mark and if you're fishing below that you're sea-angling and not within the remit of freshwater regulations/permits etc.

Generally, that is. There are some exceptions in the ROI as regards "Ministerial Fisheries" in, iirc, 11 estuaries around the country.
