Swimmers and moored boats

Lads can any of you fill me in on who would be in the wrong if a swimmer hit there head or got hurt in some way from my boat / raised engine,

I started thinking of putting something around / over the prop shaft when the boat is moored and the engine raised as this is a busy beach with lots of kids swimming along the beach and of course the odd one will swim out to the boats,

I got to thinking if one of these kids didn’t understand that boats don’t hold the one spot at anchor and could turn in a flash and catch them off guard,

But today as I readied the boat for a bit of fishing I seen a large group of adult swimmers coming my way they seemed to be using my buoy as a direction marker but as I watched them I seen that most of the time there heads where under water with just the odd glance up to check there direction,

I wasn’t the least bit surprised to see a guy swim right into my large orange buoy… then he looks up at me as if I had pushed in front of him,

By this time I’m getting the camera out to show this to a mate when bang I see a woman has hit the rope and came up for air… I did get footage of the next guy that swam over the buoy rope that leads to the boat but he slid over it like an eel and didn’t batter an eye lid just carried on his merry way,

Now while I was worried about kids not having the sense to tell them to stay clear of boats it seems to be the adults that may cause me problems,

I heard the girl that hit the rope tell her friend that she couldn’t see a thing with the goggles on

What I need to know is where I stand in all of this… is it going to cost me big time if they get hurt.

I'm not expert but if your boat is moored up and someone bumps into it surely its like someone hurting themselves by running into a parked car, Its got to be their own fault.
Its like someone falling off a cliff edge and complaining that there is no railing, if the person is stupid enough to do it they have got to take responsibility for there own
actions too much blame being passed around these days when its peoples own fault

i think while your moored, the boat is treated as private propertyand anyone close enough to touch it is tresspassing

I’m surprised that no one has replied to this with an experience of there own… as in someone hitting there boat and trying to claim from them… I suppose no news is good news

I took it out of water 2 days ago and its now safely parked up on dry land but hope to get out again shortly so will be looking around to find the answer to my worry elsewhere,

Will pop back if I get any info about this… Thank's Gents for the reply’s,
