Hi

I am not sure of the exact legal position but any illegal activity found on youtube would require the company (similar to an ISP) to assist gardai or other authorities in the pursuit of the people responsible for illegal activity. Here it is clear that the person who filmed the event is the active agent so there is no room for denial. If the bass can be proven to be below the minimum size, and that should be possible by comparing it to the spear gun, the authorities can pursue a case. The only question would be whether it can be proven that the film was taken in Irish waters....

If the fisheries board were interested I think they could approach youtube to get information.

For what its worth...
